ACCEPTANCE OF TERMS AND CONDITIONS OF USE
IMPORTANT – THIS IS A LEGAL AGREEMENT BETWEEN EACH END USER (“USER,” “YOU,” OR “YOUR”) AND AWARE (“AWARE” OR “COMPANY”). PLEASE READ THESE TERMS OF SERVICE (“AGREEMENT,” “TERMS,” OR “TERMS OF USE”) CAREFULLY AS THEY GOVERN YOUR USE OF THE AWARE WEBSITE LOCATED AT https://beaware.online (THE “SERVICE”). THE SERVICE CONTAINS TEXT, GRAPHICS, LOGOS, IMAGES, AUDIO, VIDEO, TRAINING MATERIALS, AND OTHER CONTENT, AS WELL AS FEATURES, PRODUCTS, AND CONSULTING SERVICES DISCUSSED OR OFFERED THROUGH THE SITE (TOGETHER, “CONTENT”).
BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THE SERVICE.

1. LICENSE GRANT
Subject to your compliance with these Terms, Aware grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service for your personal or internal business purposes. Aware may change or revoke this license at any time for any reason, without notice.

2. RESTRICTIONS ON USE
All rights not expressly granted are reserved. You may not:

Modify, copy, distribute, sell, license, reverse engineer, or otherwise exploit the Service or any part of it without Aware’s written permission.
Attempt unauthorized access, probe vulnerabilities, or breach security measures of the Service.
Use the Service in any way that is illegal, infringes upon others’ rights, or could damage Aware or its users.
Use the Service to transmit spam, bulk messages, or other unsolicited communications.
Collect, use, or share personal data without valid consent or legal basis.
Use the Service to post unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable material.

3. GENERAL RIGHTS YOU GRANT US
You grant Aware the right to use your device’s processor, bandwidth, and storage to facilitate the Service, and to provide advertising and updates. You grant Aware a perpetual, worldwide, royalty-free license to use and distribute any data or content you submit, as necessary to provide and improve the Service.

4. ELIGIBILITY
You must be at least 13 years old to use the Service. You represent that you are not barred from using the Service under applicable laws.

5. USER OBLIGATIONS
You agree to comply with all applicable laws and provide accurate, up-to-date information when using the Service. You are responsible for your use of the Service and any activity under your account.

6. RESPONSIBILITY FOR CONTENT
(a) Aware is not responsible for any misuse of the Service or for verifying the accuracy of user-submitted content.

8. ACCOUNT
If you create an account, you must keep your credentials confidential and are responsible for all activity under your account. You agree to notify Aware immediately of any unauthorized access.

9. FEES & SUBSCRIPTIONS
The Service may offer both recurring subscriptions and one-time purchases (“Plans”). By purchasing a Plan, you agree to pay the fees as indicated, including any applicable taxes and carrier fees.

Payments will be billed in advance and will recur until canceled.
All sales are final. Aware may offer refunds or credits at its discretion during special campaigns.
If your payment method fails, Aware may suspend or terminate your access to the Service.
You agree to keep your billing information accurate and up to date.

10. MOBILE SERVICES
Your mobile carrier’s fees may apply to your use of the Service. Aware is not responsible for carrier fees or limitations on your use of the Service.

11. DATA COLLECTION & COMMUNICATIONS
By using the Service, you consent to Aware’s collection and use of data as described in the Privacy Policy. Aware may send you electronic communications related to the Service.

12. PRIVACY POLICY
Please review Aware’s Privacy Policy for details about how we collect, use, and protect personal data.

13. FEEDBACK
If you submit feedback, you grant Aware a worldwide, royalty-free license to use it in any way.

14. LINKS TO THIRD-PARTY SITES
The Service may include links to third-party sites. Aware is not responsible for these sites or any dealings you may have with them.

15. PROPRIETARY RIGHTS
This Agreement does not transfer ownership of any part of the Service or content. Aware retains all intellectual property rights.

16. CONFIDENTIALITY
You agree to protect Aware’s confidential information with at least the same degree of care you use to protect your own.

17. NO AGENCY
This Agreement does not create a partnership, agency, or employment relationship between you and Aware.

18. DISCLAIMER
THE SERVICE IS PROVIDED “AS IS.” AWARE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ASSUME ALL RISKS OF USING THE SERVICE.

19. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWARE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. AWARE’S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID IN THE LAST 12 MONTHS.

20. INDEMNIFICATION
You agree to indemnify and hold Aware harmless from any claims arising from your use of the Service or violation of these Terms.

21. SECURITY & ENFORCEMENT
Aware may monitor and share your use of the Service as needed to comply with laws or protect Aware’s rights.

22. INJUNCTIVE RELIEF
Aware may seek injunctive relief if you breach these Terms.

23. GOVERNING LAW
These Terms are governed by the laws of Brazil, with jurisdiction in the courts of Florianópolis, SC. Any claim must be brought within one year.

24. COMPLIANCE WITH LAWS
You represent that your use of the Service complies with all applicable laws, including data protection and anti-spam laws.

25. TERM & TERMINATION
This Agreement takes effect when you start using the Service and continues until terminated. Aware may terminate your access at any time without notice. You must delete all copies of the Service upon termination.

26. WAIVER & SEVERABILITY
If any part of this Agreement is held unenforceable, the remaining provisions remain in effect.

27. MODIFICATIONS
Aware may update these Terms at any time. Continued use of the Service after updates constitutes your agreement to the new Terms.

28. ENTIRE AGREEMENT
This Agreement and the Privacy Policy constitute the entire agreement between you and Aware.
